TERMS OF SERVICE

1. Agreement

By accessing or using the MAQTOU platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. MAQTOU reserves the right to update these terms at any time. Continued use constitutes acceptance of any changes.

2. Service Description

MAQTOU is a technology platform that connects drivers in need of roadside assistance ("Customers") with independent service providers ("Merchants"). MAQTOU does not directly provide roadside assistance. Merchants are independent contractors, not employees of MAQTOU.

3. User Accounts

You may use certain features without an account. Creating an account requires accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

4. Service Requests

When you submit a service request, MAQTOU attempts to match you with the nearest available Merchant. Submission does not guarantee service. MAQTOU is not liable for delays, unavailability, or quality of service provided by Merchants. Response times are estimates, not guarantees.

5. Pricing & Payment

Prices shown on the platform are base rates and may vary based on location, time, or complexity. Final pricing is confirmed before dispatch. Currently, all payments are cash-based between Customer and Merchant. MAQTOU collects a commission from Merchants, not from Customers.

6. Merchant Terms

Merchants are independent contractors. By joining the MAQTOU network, Merchants agree to: maintain valid identification and proper tools, provide accurate location data, upload proof of service completion, maintain a minimum wallet balance, and accept the platform commission rate of 20%.

7. Cancellations

Customers may cancel a request before a Merchant accepts it at no cost. Cancellations after acceptance may result in fees depending on Merchant travel. Merchants who repeatedly decline or fail to respond to jobs may face account restrictions.

8. Disputes

Disputes between Customers and Merchants can be raised through the platform. MAQTOU will review photo proof, GPS data, and timestamps. MAQTOU's decision on disputes is final. We aim to resolve disputes within 24–48 hours.

9. Prohibited Conduct

You may not: use the platform for unlawful purposes, provide false information, harass or threaten other users, interfere with platform operations, create multiple accounts to circumvent restrictions, or engage in fraudulent activity.

10. Limitation of Liability

MAQTOU is a technology platform, not a roadside assistance provider. To the maximum extent permitted by law, MAQTOU is not liable for: damage to vehicles during service, personal injury, delays in service, acts or omissions of Merchants, or any indirect or consequential damages.

11. Termination

MAQTOU may suspend or terminate your account at any time for violation of these terms, fraudulent activity, or at our discretion. You may delete your account at any time by contacting support.
